These Terms of Use are an agreement between you and Gest Vantage LLC, Illinois, USA (“we”, “us”), the company that makes Iris. They cover the Iris app for iOS and Android and the website irisjournal.app. By creating an account or using Iris, you agree to them. If you don’t agree, please don’t use Iris.
Our Privacy Policy explains how we handle your data and is part of these terms.
1. Who can use Iris
You must be at least 18 years old. By using Iris you confirm that you are. One account is for one person.
2. What Iris is — and what it isn’t
Iris is an AI journaling companion for self-reflection. You can write or talk to it, and it reflects back what it hears and asks questions.
Iris is an AI, not a person. It will say so whenever you ask.
Iris is not therapy or medical care. It is not counseling, psychotherapy, medical advice, diagnosis or treatment, and it is not a substitute for a doctor, therapist or other qualified professional. Nobody at Iris reads your conversations to give you advice. If you have a health concern, talk to a professional.
Iris is not for emergencies. If you are in danger or thinking about harming yourself or someone else, call your local emergency number (911 in the US) or a crisis line now. Helplines are listed at irisjournal.app/safety and under Get help now in the app’s Settings.
3. AI can make mistakes
Iris’s replies are generated automatically. They can be inaccurate, incomplete, out of date or inappropriate, and Iris may misunderstand you. Don’t rely on Iris for decisions about your health, safety, legal or financial matters. You are responsible for what you do with its replies.
4. Your content
What you write and say to Iris, and the transcripts of your voice calls, are yours. You give us permission to store and process them only as needed to provide Iris to you — to write replies, keep your conversations and Memory, and run the service — as described in the Privacy Policy. We never use your content to train AI models.
You can delete conversations and memories at any time, and deleting your account deletes your content.
5. Acceptable use
Please don’t:
- break the law or use Iris to harm, threaten or harass anyone;
- try to get Iris to produce content that sexualizes minors, promotes self-harm or violence, or is otherwise illegal;
- try to break, overload, reverse-engineer or get around the limits or security of Iris;
- use Iris on behalf of, or to collect data about, someone else without their permission;
- resell or automate access to Iris, or use it to build a competing product.
We may suspend or close an account that breaks these rules or puts others at risk. Where the law requires, we’ll tell you why and how to appeal.
6. Reporting a response
If a reply is harmful, offensive or wrong, long-press it and choose Report. Reports help us make Iris safer. You can also write to support@irisjournal.app.
7. Free plan and subscriptions
Free plan. Every account includes a limited number of free messages, which don’t reset. Voice may not be included. The app shows your current limits.
Subscriptions. A subscription adds a monthly allowance of messages and voice minutes. Plans, prices, allowances and any free trial are shown in the app before you buy, and in the App Store or Google Play. Allowances renew each calendar month; what’s left over doesn’t carry over. We may change plans, allowances and prices; a price change applies from your next renewal, and the store will ask you or notify you as its rules require.
Billing through Apple or Google. Subscriptions are bought and billed by Apple (App Store) or Google (Google Play), not by us. A subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. If you start a free trial, you are charged when the trial ends unless you cancel before then.
Cancelling and refunds. Cancel in your App Store or Google Play account settings. Deleting your Iris account does not cancel a subscription. Refunds are handled by Apple or Google under their policies; we can’t issue them ourselves. This doesn’t limit any right to withdraw or get a refund that your local consumer law gives you.
8. Deleting your account
You can delete your account at any time in Settings → Delete account, or as described at Delete your account. Deletion is permanent. You can also simply stop using Iris.
9. Our service
We work to keep Iris available and improving, but we may change, add or remove features, and Iris may sometimes be unavailable. If we ever shut Iris down, we’ll give you reasonable notice where possible.
Iris, its name, design and software belong to us and our licensors. We give you a personal, non-transferable, non-exclusive, revocable license to use the app on devices you own or control, under these terms and the store’s rules.
10. Disclaimers
To the fullest extent the law allows, Iris is provided “as is” and “as available”. We don’t promise that Iris will be uninterrupted, error-free, or that its replies will be accurate or suitable for any particular purpose, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of Iris. Our total liability for any claim relating to Iris is limited to the greater of the amount you paid for Iris in the 12 months before the claim and US $100.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, or for fraud. If you live in the EU, the UK or another country with mandatory consumer protections, you keep all the rights those laws give you, and these terms don’t take them away.
12. Indemnity
If you use Iris in breach of these terms or the law and someone makes a claim against us because of it, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows. This doesn’t apply to consumers where local law prohibits it.
13. Apple App Store terms
If you got Iris from the Apple App Store, these terms also apply:
- These terms are between you and Gest Vantage LLC, not Apple. We, not Apple, are solely responsible for Iris and its content.
- Your license is limited to using Iris on Apple-branded products you own or control, as allowed by the Usage Rules in the App Store Terms of Service.
- We, not Apple, are responsible for maintenance and support. Apple has no obligation to provide any maintenance or support for Iris.
- If Iris fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent the law allows, Apple has no other warranty obligation for Iris; any other claims, losses, liabilities, damages, costs or expenses from a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to Iris or your use of it, including product liability claims, claims that Iris fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that Iris or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms when using Iris, such as your mobile carrier’s.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.
- Questions, complaints or claims about Iris go to us at support@irisjournal.app.
14. Google Play
If you got Iris from Google Play, Google Play’s Terms of Service also apply to your purchase and download. Google is not a party to these terms and is not responsible for Iris.
15. Governing law and disputes
These terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws rules. Disputes will be heard in the state or federal courts located in Cook County, Illinois, and you and we consent to their jurisdiction.
If you are a consumer living outside the United States, you also have the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there.
Before going to court, please write to support@irisjournal.app — most problems can be solved that way.
16. Changes to these terms
We may update these terms. We’ll change the date at the top, and if a change is material, we’ll tell you in the app before it takes effect. If you keep using Iris after that, the new terms apply. If you don’t agree, you can delete your account.
17. General
If part of these terms can’t be enforced, the rest stays in effect. If we don’t enforce a term right away, we haven’t given up the right to. You can’t transfer these terms to someone else; we may transfer them as part of a merger or sale of the company. These terms, with the Privacy Policy, are the whole agreement between you and us about Iris.
